You cant be sued for having a simialar, yet defferent idea then someone else. Go to ning.com and search clubpenguin.

| There are only a few results, but most aren't copyrighted. Only PengSpace and PengBook do, oh and PengTube. (Shockingly similar names eh? Ha ha ha.)
